Terms of Service

These Terms of Service ("Terms") govern your use of Smart Fleet Manager ("Service"), operated by Digixskill ("Digixskill", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Smart Fleet Manager is a SaaS platform for fleet, driver, booking, compliance, and operations management. Features and availability may change over time.

2. Accounts & Authority

You must be of legal age and, if signing up on behalf of an organization, you confirm you have authority to bind that organization. You are responsible for keeping your account credentials confidential and for all activity under your account. Information you provide must be accurate and kept up to date.

The Service, including all software, documentation, and branding, is owned by Digixskill and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of the data and content you upload; you grant us a limited licence to host and process it solely to provide the Service.

5. Payments & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms and our Refund Policy. Payments made through Razorpay (India) are collected by Digixskill.

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Suspension & Termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, you may export your data during a reasonable window before it is deleted.

8. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from the Service is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill), except where such exclusion is prohibited by law (e.g., fraud or death/personal injury).

You will indemnify Digixskill against claims arising from your content, your unlawful use of the Service, or breach of these Terms.

10. Governing Law

These Terms are governed by the laws of India. Disputes will be resolved by the competent courts in India, subject to any mandatory local consumer-protection laws that apply to you.

11. Changes

We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use after changes take effect constitutes acceptance.
